Standard Terms and Conditions

governing the rules of the “Let’s Do More Summer Promotion”

1.1 The “Let’s Do Summer Promotion” is only valid between 09 Jan – 31 March 2017. Ezemvelo KZN wildlife reserves the right to cancel or amend the promotion and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the promoter’s control. Any changes to the campaign will be notified to entrants as soon as possible by the KZN Wildlife.

1.2 For the purpose of “Let’s Do Summer Promotion””, all published specials and promotions apply to all Ezemvelo KZN Wildlife properties with the exception for Hilltop Resort and Mpila Resort at Hluhluwe Imfolozi Park.

1.3 The “Let’s do Summer” promotion cannot be booked in conjunction with any other discounts or specials and excludes all events, school holidays, public holidays and long weekends.

1.4 The “Let’s do Summer” promotion only applies to new bookings and all existing bookings are exempted.

2. Booking terms and conditions:

2.1 All reservations are accepted subject to the provisions of the Natal Nature Conservation Ordinance, No. 15 of 1974, the KwaZulu-Natal Nature Conservation Act, No. 29 of 1992, as well as the KwaZulu-Natal Nature Conservation Management Act, No. 9 of 1997, and the regulations promulgated thereunder, as amended.

2.2 Your credit card serves as a guarantee for this booking. An immediate 100% deposit is required to secure the reservation.

2.3 Refunds on or after the arrival date will be processed by the Regional Office, on recommendation from the camp. Only cancellation made prior to arrival will be processed at Central Reservations. An administrative management fee will be levied on all cancellations, except those contemplated in 17.5 of the Consumer Protection Act (CPA).

  • ·Cancellations/amendment> than 45 days prior to arrival = 10% of net amount (Min R100).
  • ·Cancellation/amendment within 45 to 30 days of arrival     = 25% of the net amount.
  • ·Cancellation/amendment within 29 to 15 days of arrival     = 50% of the net amount.
  • ·Cancellation/amendment within 14 days & arrival date      = 100% of the net amount
  • No arrival date postponement on accommodation that’s on promotion.

2.4 Visitors shall inform the Reservations office in Pietermaritzburg of changes to their reservations timeously.

2.5 Visitors are requested to note arrival and departure times as well as gate closing times.
Check in time - from14h00 until reception closes on the arrival date, Check out time – not after 10h00 on the day of departure.

  • All Resorts (Excl. those below): Oct to Mar = 05h00 - 19h00 and Apr to Sept = 06h00 - 18h00.
  • Thendele: Oct to Mar = 05h00- 22h00 and Apr to Sept. = 06h00- 22h00.
  •  Cape Vidal : Nov to Mar = 05h00 - 19h00 and Apr to Oct 06h00 - 18h00
  • Hilltop, Imfolozi & Ithala: Nov to Feb = 05h00 - 19h00 and Mar to Oct 06h00 - 18h00.
  • Monks Cowl : 6am to 6pm all year round
  • Didima, Midmar & Sodwana Bay ARE 24 HOURS

2.6 Hluhluwe-Imfolozi Park Conservation Levy: (To be paid on arrival at the gate.). 1 Nov 2016 - 31 Oct 2017: International Visitors pay a conservation levy of R210.00 per person per night. South African Visitors pay R105 per person per night. Ezemvelo gates – Valid Rhino Gold Card and Wild Card members are accepted for free entry at all gates, except at those gates controlled by iSimangaliso and are also dependant on the cluster and number of people the card was purchased for. The total number of people may under no circumstances exceed the total number of beds indicated on this advice form. A maximum of 2 children (12years & under) may stay free once the base rate is met, thereafter a supplementary accommodation fee is payable for additional children. Dinner and activities are payable irrespectively.

2.7 All hutted accommodation units are fully equipped, including refrigerators, bedding, crockery and cutlery (except in all rustic accommodation and mountain huts).

2.8 No mechanical generators are allowed to be operated within the Parks. Visitors are advised to bring a torch.

2.9 No pets allowed in any reserve of park.

2.10 Whilst every effort will be made to accommodate requests for specific units or sites, this cannot always be guaranteed.

2.11 Limited foodstuffs are obtainable at certain reserves and resorts. Ithala (Ntshondwe), Giants Castle, Didima, and Hluhluwe (Hilltop) have restaurant facilities. Take away style light meals are available at uMkhuze (Mantuma).

2.12 You are advised to take precautions against malaria before, during and after your visit to reserves north of the Tugela River. Please consult your doctor/ pharmacist.

2.13 Ezemvelo provides facilities at certain resorts for the physically disabled, contact the Central Reservations Office for more details.  These units are subject to availability. 

3 Competition Standard Terms & Conditions :

3.1 These terms and conditions are applicable in respect of all entrants participating in any competitions which may be run or promoted by Ezemvelo KZN Wildlife (whether on the Website, Facebook page or otherwise) along with any specific terms it publishes that may apply to each competition. These Competition Standard Terms & Conditions form part of the general Terms & Conditions generally for the Website and both sets of terms are expressly incorporated into any specific terms for any KZN wildlife competitions.

3.2 In the event of any conflict and/or discrepancy between these Competition Standard Terms & Conditions, the Terms & Conditions and any specific terms for a competition, the relevant terms of a specific competition shall apply. KZN Wildlife or any of its associated companies reserve the right to disqualify your entry from any competition and/or withhold any prize if they have reasonable grounds to believe that you have breached any of these Competition Standard Terms & Conditions, Terms & Conditions or any specific rules of any competition (all three together are referred to as “Competition Terms & Conditions”).

3.3 To enter a competition and to be eligible to win a prize you must:   

  1. Be resident in the Republic of South Africa unless permitted otherwise in the specific terms and conditions of a competition);
  2. Be 18 years of age or over (or of the age specified in the competition and, if minors are stated to be eligible to enter a competition, then they must have the express consent of their parent(s) or guardian);

  3.   Not be an employee of KZN Wildlife or any of its related companies or any service provide (or employee or agent thereof) to KZN Wildlife or a member of the family, friend or acquaintance of any of the above; and
  4.   Comply with these Terms & Conditions and any rules specific to the competition. All entry instructions communicated by KZN Wildlife will form part of the Competition Terms & Conditions
  5. By entering any competition and/or accepting a prize from KZN Wildlife you warrant that you have complied, and shall continue to comply, with these Competitions Terms & competition at KZN Wildlife request and/or to allow KZN Wildlife to use your name, image and/or town of residence in such promotional materials as KZN Wildlife sees fit whether now or in the future and anywhere in the Republic of South Africa or in the world, without any further compensation.

3.4 All entries must be made in the entrant's own full names. Where applicable, KZN Wildlife will

3.5 Closing Date: the closing date for a competition is the date and/or time as stated in the instructions for the respective competition and, unless otherwise stated, entries must be received by KZN Wildlife on the closing date by the following times (in accordance with the method as permitted in the relevant competition rules:

 

(i) Midnight for entries by email and/or online; or

(ii) 4pm for entries by post or other method; or

(iii) Midnight for entries by telephone or SMS (unless on live or as-live programming; or

(iv)  As may be otherwise directed in respect of competitions on live or as-live programming;

 

3.6 Where competition entries are made by telephone or SMS, the costs of entry will be stated in the relevant specific terms of the competition.

3.7 One entry allowed per household unless expressly stated otherwise in the relevant specific  terms of the competition.

3.8 There are no prize substitutions nor are cash alternatives and the prizes not transferable. KZN Wildlife reserves the right to select an alternative Winner and award the prize to another entrant in the event that:

  1. It has reasonable grounds for believing that an entrant has contravened any term or condition of entry;
  2.  A Winner has changed address to one outside of the Republic of South Africa, after the closing date;
  3. It is unable to contact the Winner within 24 hours of selecting the Winner;
  4. It does not receive confirmation of the Winner’s address as may be requested within 24 hours.

3.9 KZN Wildlife will have a sole and an absolute discretion to decide whether or not to accept any entry and KZN Wildlife may rely upon its own records and information in determining whether contestants are eligible to receive a prize.

3.10 In any matters concerning any part of the competition or any part of the solution to competition, whatsoever, KZN Wildlife’ decision will be final and no correspondence or discussion shall be entered into with you or with any other person acting on your behalf regarding the decision whatsoever.

3.11 A winner will generally be notified either by email, telephone or post within 14 days of  the relevant closing date or such other times as may be specified by KZN Wildlife in its  absolute discretion.

3.12 A winner has a responsibility to find out from KZN Wildlife what the competition prize entails and does have to assume what is included in the prize if not clear the winner. 

3.13 Subject to confirmation by KZN Wildlife of the Winner’s address as may be requested, the Winner will generally receive the prize within six to eight weeks from the closing date or as set out in any specific terms for the respective competition

3.14 No responsibility can be accepted for entries lost, delayed, misdirected, damaged or shall not be responsible for technical errors in telecommunications networks, internet access

3.15 Where any prize involves travel, all arrangements, including but not limited to travel times and dates, shall be in accordance with the restrictions specified by KZN Wildlife and, unless stated otherwise in writing, shall take place within 12 months of the relevant closing  medical advice for their trip and confirm all necessary travel documents, including a passport,   prior to any travel.

3.16 KZN Wildlife shall not be liable for any delay in performing or partial or total failure to perform any of its obligations to the winner(s) under these Competitions Terms if such delay

  limitation delays, changes, disruptions, cancellations, diversions or substitutions howsoever caused including without limitation, war, terrorist action or threatened terrorist action, strikes,

  hostilities, civil commotions, accidents, fire, flood or any natural catastrophes arising without limitation out of or in connection with the activities of any third party and/or any form of

  transportation (including but not limited to flights, trains, coaches, buses, ferries, taxis or incurred as a result.

3.17 To the extent permitted in law, KZN wildlife shall not be liable to the winner(s) for any loss or damage howsoever caused (whether in contract, tort or statutory duty or otherwise)   arising out of or in connection with the competition and/or prize other than death or personal  injury caused by negligence of the Promoter and/or the Promoters personnel and/or deceit

3.18 Any personal information collected by KZN Wildlife in connection with a competition will be used in accordance with KZN Wildlife’s Privacy Policy. If entrants do not want KZN wildlife to use their information in this way, entrants can tell KZN Wildlife when entering the   competition or at any time by writing to KZN Wildlife.

3.19 A list of winners for each competition can be obtained by sending a stamped addressed envelope marked clearly “[INSERT NAME OF THE RELEVANT COMPETITION]” to KZN Wildlife within 30 days from the date of the closing date of the competition.

3.20 Competitions Terms shall be governed by and construed in accordance with the laws courts of   RSA

INDEMNITY

The KwaZulu-Natal Nature Conservation Board and the Kwazulu-Natal Conservation Service (Trading as Ezemvelo KZN Wildlife) does not accept the responsibility for any death, injury or illness sustained or suffered by any persons, or theft or loss of or damage to any property occurring within or arising from a visit to parks or resorts under their control, however caused and allegedly due the negligence of the Service or any of their employees or arising from the use of any facilities supplied or made available.
