EZEMVELO KZN WILDLIFE PROTECTED AREAS.

rights set out in Annexure 'A' hereto. We acknowledge that any rights granted in pursuance to this
application will be subject, strictly, to the conditions which follow and agree to be bound by and
to adhere strictly to the said conditions and to such regulations as may be in force from time to
time for the control and management of the areas under the control of the KZN Nature Conservation
Board, hereinafter referred to as the Board, and represented by Ezemvelo KZN Wildlife, hereinafter
referred to as KZN Wildlife. We also acknowledge that KZN Wildlife shall reserve the right not to
approve of any or all of the concessions and assistance applied for.
- All filming/photographing and or recording in any areas under KZN Wildlife's jurisdiction may
only be done with the express consent of the appropriate Regional Manager of the relevant
reserve.
- Applications for any of the said rights shall be made
not later than one month (30 days) before the proposed date of commencement of
operations.
Shorter notice periods will incur a 10% fee penalty;
- The granting of any rights shall be at the sole discretion of the Regional Manager subject to
such conditions as KZN Wildlife may impose. No rights will be granted which KZN Wildlife does not
consider to be in its interests.
- The purpose for which any films, tape or video recordings or photographs are to be used and the
particulars as to where and, if possible, when they are going to be shown, exhibited, published or
played, shall be made as follows:

- The following fees and charges excluding fees enumerated in 6 (b) below, shall be paid as
requested, either in advance or on commencement of the exercise of any rights granted by KZN
Wildlife:

One copy of the film (with sound track), or of the tape recording (or disc), or a complete
set of 12,5cm x 17,5cm prints of any photographs actually to be published, or a copy of the
publication, shall be donated and delivered to KZN Wildlife within three months (or such extended
period as may be allowed by KZN Wildlife) of the completion of filming, recording or photographing
in terms of this application. The items so donated shall be used by KZN Wildlife only for
educational and information purposes and no admission or any other charge will be levied therefore.
Feature and advertising films/photographers are exempt from this clause.
- A deposit, the amount of which will be determined from time to time, will be lodged with KZN
Wildlife by the applicant, this deposit being refundable on receipt of the aforementioned film,
tape recording (or disc), or of the photographs for publication. In the event that this material is
not received, the deposit shall be forfeited to KZN Wildlife.

Any film, recording, photographs or books, shall in its published version, record a
suitable acknowledgement to the co-operation and assistance of KZN Wildlife.
- No unnecessarily dangerous or unnatural scenes, films, recordings, photographs, or anything
that may conflict with KZN Wildlife's policies will be permitted. KZN Wildlife's decision in
respect of such matters shall be final. (Refer to AWFA Code of Conduct)
- Undertaking: during the course of filming, recording or photographing the applicant or its
representatives shall in no manner whatsoever cause injury or stress to or death of any wild bird
or animal, or damage or destroy any plant or rock without prior written authority of KZN
Wildlife.
- No films, tape recordings or photographs which require the assistance of KZN Wildlife personnel
may be made or taken during peak visitor pressure periods, except with the express prior approval
of the relevant Regional Manager.
- The filming, recording or photographic activities covered by this application shall, if
assented to by KZN Wildlife, not be conducted in a reserve without the prior approval of the
officer in charge of that reserve.
The applicant's staff shall report to that officer on arrival or before commencing their
activities in the particular protected area.
- KZN Wildlife accepts no responsibility for death, any injury or illness sustained or suffered
by any person, or theft, loss or damage to any property, occurring within areas under KZN Wildlife’s
jurisdiction, or arising from the activities covered by this application. Signature of this
application by the applicant shall ipso facto indemnify KZN Wildlife and its staff from any claim
whatsoever arising at the instance of the applicant, its directors, employees, agents, actors or
actresses. The applicant further warrants that it is duly authorized and entitled to give this
indemnity on behalf of the persons mentioned above.

By signing this document, the applicant agrees to adhere strictly to the attached African
Wildlife Film-makers Association (AWFA) Code of Conduct. A fee discount applies to members of AWFA
or crews that include AWFA members.
- In the event of the applicant being in breach of any of the conditions set out above, or of any
further conditions imposed by or on behalf of KZN Wildlife, or in the event of the applicant or any
of the applicant's employees committing any offence or being objectionable, in the opinion of a KZN
Wildlife officer, KZN Wildlife shall have the right forthwith to cancel this agreement and to
require the applicant and its employees to vacate any area under the control and management of KZN
Wildlife with no refund of any fees paid.
- The applicant acknowledges that KZN Wildlife’s signature hereunder by its Chairman or other
delegated Officers constitutes its approval and a valid and binding agreement between KZN Wildlife
and the Applicant.
- The Officer in Charge of the relevant reserve shall issue a letter of clearance once the area
used has been satisfactorily cleared. If the area used is not cleared by the date stipulated in 8
of Annexure "A" - a penalty fee of
R500.00 per day shall be payable by the applicant until the letter of clearance is
issued.

AFRICAN WILDLIFE FILM MAKERS ASSOCIATION (AWFA)
CODE OF CONDUCT AND ETHICS GUIDE
PREAMBLE
It is accepted that members of this organisation are involved in wildlife film making because of
their love and respect for the natural environment and all the wild creatures it embraces. Members
should never view subjects as being dispensable in pursuit of excellence or for financial gain. The
aim of the African Wildlife Film-makers AssociationMau is to share with viewers the wonders of the
many intriguing life forms that inhabit this planet.
GENERAL PRINCIPLES
Members should:
- Research their subjects properly before entering an area so that they fully understand the
consequences of their actions on their surroundings.
- Strive to portray as accurately as possible authentic and natural behaviour.
- Never be involved in any activity that is cruel.
- Never cause any physical harm, nor anxiety to any wild creature for an unreasonably lengthy
period.
- Avoid using sound recordings to attract certain species for prolonged periods.
- Accept that the welfare of subjects is more important than the sequence.
- Ensure that filming does not result in the consequential predation or lessened reproduction
success of the species involved.
- Endeavour to leave the environment as it was found.
- Forge good relationships with all officials and conservation bodies they have contact
with.
- As far as possible enlist the help and heed the advice of experts when dealing with natural
history films.
- Make sure that all information included in films is accurate and scientifically
justifiable.
- Report the inhumane and illegal treatment of wild animals to the relevant authorities whenever
it is encountered.
- Vacate a scene immediately should subjects show signs of abnormal stress.
- Minimise interference in and the disruption of natural processes as far as possible.
- Cause minimal damage to the habitat if scenes are set up in the wild.
- Stick to recognised roads and bush tracks wherever possible and not cause unnecessary vehicle
damage to the bush.
- Not traverse ecological sensitive areas in a vehicle.
- Uphold the proud traditions and principles of this profession to the letter.
CAPTIVE SUBJECTS FOR FILMING
It is recognised that it is sometimes necessary to use tame animals or to make use of a captive
situation to record certain sequences.
- If it is not at all possible to record such sequences in the wild and if such an activity can
safely be set up without undue stress or injury to the subject, then only should captive situations
be used.
- Such a procedure should be set up under the guidance of a recognised scientific advisor or
animal handler.
- Capturing wild animals for filming purposes is acceptable only if the sequence cannot be filmed
in the wild and the animals are not breeding.
- After filming the captured animals should be released unhurt and with minimum delay.
- Their release should take place, if possible, in their original environment or habitat. The
territorial behaviour of competitors should always be a guiding factor.
- The tethering of animals or the restricting of its movements in any way to set up a kill scene
is strictly forbidden.
- Tame wild animals must preferably be under supervision of trained animal handlers.
- Sedatives and tranquillisers should not be used on animals for filming purposes.
- Only a veterinarian or his duly authorised assistant may administer scheduled drugs to
animals.
- Young animals may not be removed from nature and raised in captivity specifically for the
purpose of constructing a story.
- Animals kept in captivity should be adequately fed and watered and allowed sufficient rest
periods during filming to minimise stress.
- The enclosures used for captive filming must be of an adequate size and should be designed to
make the animal feel as comfortable as is reasonably possible.
- Capture of birds for filming purposes may only happen under a veterinarian’s supervision.
- The darting of animals for filming or captive reasons may only happen under a veterinarian’s
supervision.
- The appropriate conservation or parks authority must sanction the capturing of any wild
creature.
- Imprinting is acceptable only if adequate provision has been made for the animal once filming
is complete.
- Whenever tame or captive animals have been used disclaimers should be included in the end
credits stating that this was the case.
FILMING AT NIGHT
It is now common knowledge that a spotlight less affects predators at night than it does
ungulates. Recording such scenes at night with spotlights does therefore not necessary always
portray natural behaviour and can often be misleading. In both the video and film industry there
has been remarkable advancements making it possible to use the absolute minimum of light.
- Possible after dark filming should be accomplished with no lights only and using the latest
available technology.
- Spotlights for night filming should be covered with infra-red filters.
- Visible light used to illuminate a subject at night should not result in the subject being
killed or maimed by predators in unnatural or unethical circumstances.
- In the case of predators, care should be taken not to disrupt its hunting techniques for
prolonged periods so that it becomes impossible for the animal to feed itself adequately.
GENERAL
It is in the interests of viewers and conservation bodies alike that material collected in
nature reserves is continually used for educational purposes. It is therefore in the best interests
of all parties that copies of the final product be made available to the host agency free of charge
so that these can be used by them to realise their own educational objectives.
It is up to each member to see to it that colleagues enforce the set of ethics and principles
set out above. But these guidelines may prove to be worthless to anyone who does not enter the
domain of nature with the right spirit and frame of mind. They are after all only guidelines. Only
you will know what you do when you are alone out there with a camera.
So make the right choices.
